Terms and Conditions

1) We exercise no control whatsoever over the content of the information passing through this system. We make no warranties of any kind, whether expressed or implied, as to the availability, accuracy, or content of the information, products, or services it is providing. We also disclaim any warranty of merchantability or fitness for a particular purpose. We will not be responsible for any damage you suffer. This includes loss of data resulting from delays, nondeliveries, misdeliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via this system is at your own risk. We specifically deny any responsibility for the accuracy or quality of information obtained through our services.

2) Envy Communications will conduct routine scheduled maintenance of it's resources according to notification delivered to the User. In the event a mission critical maintenance situation arises, Envy Communicatinos may be required to perform emergency maintenance at any time. During these scheduled and emergency maintenance periods, the User may be unable to transmit and receive data and the User may be unable to access the User's agreed upon service. User agrees to cooporate with Envy Communications during the scheduled and emergency maintenance periods.

3) Any liability incurred by us, including without limitation any liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, deletion, defect, delay, in operation or transmission, communications line failure, theft or destruction of or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortuous behavior, negligence, or under any other cause of action, will be strictly limited to the amount paid by or on behalf of the customer to us for the current month.

4) You agree to accept any financial responsibility, to indemnify us, and to hold us harmless from any claims resulting from your use of the service which damages you or another party.

5) Any access to other networks connected to this system must comply with the rules appropriate for that other network. Although the use of this system itself may be for any lawful purpose which includes, but not limited to, respecting Intellectual Property rights. In the event of a violation of our Terms and Conditions statement or Account Use Policy, or any other system disruption which requires our technician to administrate and/or correct, the violator may be billed for the actual technician time at the then prevailing rate.

6) These Terms and Conditions supersede all previous representations, understandings, or agreements and will prevail notwithstanding any variance with terms and conditions of any order submitted. Use of this system constitutes acceptance of these Terms and Conditions.
